1. Acceptance of Terms

By accessing or using Abatta Care ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Abatta Care is an online marketplace that connects clients seeking care services with independent care providers. We facilitate the discovery, booking, and payment for care services but do not directly provide care services ourselves.

3. User Accounts

Registration

To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Client Terms

As a client using our Platform, you agree to:

  • Provide accurate information about care needs
  • Pay for booked services according to provider terms
  • Treat providers with respect and professionalism
  • Provide safe working conditions for in-home services
  • Give reasonable notice for cancellations

5. Provider Terms

As a provider using our Platform, you agree to:

  • Maintain all required licenses and certifications
  • Provide accurate information about your services
  • Deliver services as described and booked
  • Maintain appropriate insurance coverage
  • Comply with all applicable laws and regulations
  • Pay platform fees as described in our pricing

6. Bookings and Payments

Booking Process

Bookings made through the Platform constitute a service agreement between the client and provider. Abatta Care facilitates this agreement but is not a party to it.

Payments

All payments are processed through Stripe. By making a payment, you agree to Stripe's terms of service. Platform fees are deducted from provider payouts as described in our pricing.

Cancellations

Cancellation policies are set by individual providers. Please review the provider's cancellation policy before booking.

7. Reviews and Content

Users may post reviews and other content on the Platform. You retain ownership of your content but grant us a license to use, display, and distribute it on the Platform. Reviews must be honest and based on actual service experiences.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Post false, misleading, or defamatory content
  • Harass, abuse, or harm other users
  • Circumvent platform fees or payment systems
  • Scrape or harvest data from the Platform
  • Interfere with the Platform's operation

9. Intellectual Property

The Platform and its content, features, and functionality are owned by Abatta Care and are protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY CARE PROVIDERS. USERS ENGAGE PROVIDERS AT THEIR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARELINKHELP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

12. Indemnification

You agree to indemnify and hold harmless Abatta Care from any claims, damages, or expenses arising from your use of the Platform or violation of these terms.

13. Dispute Resolution

Any disputes arising from these terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Modifications

We reserve the right to modify these terms at any time. We will notify users of material changes. Continued use of the Platform after changes constitutes acceptance of the modified terms.

15. Termination

We may terminate or suspend your account at any time for violation of these terms. You may close your account at any time through your account settings.

16. Governing Law

These terms are governed by the laws of the State of Florida, without regard to conflict of law provisions.
